Sales Conditions

Preamble

The offer and sale of products through the website www.caffecamardo.com are governed by the following General Sales Conditions. The General Sales Conditions are formulated in accordance with the legislation on contracts concluded outside of commercial premises, and in particular, as provided by Legislative Decree of September 6, 2005, No. 206 (Consumer Code).

Contractual Parties

The contractual parties are as follows:

Application and Modification of General Sales Conditions

By placing an order as provided, the Customer declares to have read all the information provided during the purchase process and to fully accept the General Sales Conditions. Camardo S.p.A. reserves the right to change the General Sales Conditions by giving notice on this page of the website. The applicable General Sales Conditions are those in force at the time of placing an order. Any modification will be effective upon publication on the website.

Website Registration

Registration with a username and password is optional. If the Customer does not wish to register, they can still make a purchase: only the necessary data for delivery and any invoicing of an order will be required.

Product or Service Characteristics and Prices

Product images may not perfectly represent their characteristics but may differ in color, size, and represented accessories. All purchasing support information is to be understood as simple generic informative material, not referring to the actual characteristics of an individual product.

Products are offered at the price indicated on the website at the time an order is placed. Coffee products are removed from sale 6 months before the expiration date. Prices include VAT, which will be detailed on the product purchase invoice.

Prices do not include shipping and delivery charges, which are indicated in the final section before submitting an order and specified in the order receipt confirmation sent via email to the Customer.

Order Placement

Orders can only be placed to and from the Italian Republic and certain EU and non-EU areas.

Orders are not subject to minimum or maximum quantity limitations, and products are offered subject to stock availability.

Where available, promotional codes offered by Camardo S.p.A. are valid only for the products and during the period indicated from time to time. Promotional codes are not refundable and cannot be combined. To take advantage of discounts and/or offers associated with promotional codes, the promotional code must be entered in the appropriate space at the time of validating an order on the website. In case of forgetfulness, an order cannot be canceled or renewed to consider the promotional code.

The steps to place an order and conclude the purchase contract are clearly highlighted in the sequence of website pages through explanatory texts and graphics.

After payment confirmation, the order cannot be canceled or modified.

Order Receipt Confirmation and Acceptance

Upon receiving an order, Camardo S.p.A. will automatically send a receipt confirmation via email, summarizing all the details of the order. Following receipt of an order, Camardo S.p.A. will verify the availability of the ordered product, and only after this verification will communicate its acceptance of an order and dispatch the product.

If Camardo S.p.A. is unable to fulfill a received order, it will promptly notify the Customer.

The customer has no right to damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or property caused by the non-acceptance of an order.

Accepted Payment Methods

Camardo S.p.A. accepts payment only through the following systems:

Credit card (American Express, Visa, or Mastercard); through the Stripe payment platform. The total amount of an order will be charged only upon the actual shipment of the products.
PayPal: an online payment system that allows any company or consumer with an email address to send and receive payments, upon registration. Payment is made through the PayPal payment platform.
Cash on delivery: payment will be made in cash to the express courier upon delivery.
Product Shipping

Product shipments and deliveries can only be made within the territory of the Italian Republic. Camardo S.p.A. will ship the purchased products exclusively to the destination specified in an order. Shipments to PO Boxes are not accepted.

Camardo S.p.A. will ship the products ordered by the Customer via Courier to the address provided by the Customer, generally within 3-5 working days. The indicated times for receiving the goods are indicative.

Delivery charges are invoiced based on the rates indicated on the website at the time an order is placed.

The courier is responsible for delivery. In case of any reports of non-delivery or delayed delivery of products, it is recommended to contact Customer Service at +39 3714201300, from Monday to Friday from 9:00 am to 1:00 pm.

Customer Acceptance of the Product

Any packaging and/or product damage or discrepancies in the number of packages or indications must be immediately contested by specific indication on the delivery document. By signing the courier document, the Customer attests to the actual external integrity of the product and the conformity of the delivery.

Any issues regarding the actual physical integrity, correspondence, or completeness of the products received must be reported within 2 days of delivery by sending an email to info@camardo.shop, or by calling +39 3714201300, from Monday to Friday from 9:00 am to 1:00 pm.

Invoicing

An invoice will be issued for each order of a private Customer who has provided their tax code, and for each order of a professional Customer or company with a VAT number. The information provided by the Customer at the time of ordering will be used for invoicing. No changes to the invoice will be possible after its issuance. During the order process, it is necessary to indicate if the shipping address is different from the billing address.

Right of Withdrawal and Return Rules

In execution of the provisions of Legislative Decree of February 21, 2014, No. 21 implementing Directive 2011/83/EU on consumer rights, the Customer may return the purchased product and obtain a refund of the actual purchase amount paid.

Within 14 days from receiving the product, the Customer must send a registered letter with return receipt to Camardo S.p.A. – Via Bartolomeo Camardo, 2 – 86025 Ripalimosani (CB). The communication can also be sent, within the same period, by email to info@camardo.shop.

Upon receiving the withdrawal communication, Camardo S.p.A. will contact the Consumer to communicate the address where the products must be returned; the Consumer will then return the products to Camardo S.p.A. in accordance with these instructions within the next 14 days. Within 14 days from receiving the withdrawal communication, Camardo S.p.A. will fully refund the price paid by the Consumer. The return shipping costs to Camardo S.p.A. are borne by the Consumer. An essential condition for exercising the right of withdrawal is the substantial integrity of the products to be returned.

If the value of the products has decreased due to handling other than necessary to establish the nature, characteristics, and functioning of the

products (for example: damaged products, not properly or fully packaged, or missing or damaged parts such as components, elements, accessories, packaging materials, boxes, documentation, and/or other items), Camardo S.p.A. will refund the purchase amount less the value of such decrease to the Customer. In case the Customer returns products beyond the aforementioned term or in the case of opened and/or partially used products that are not suitable for return, the right of withdrawal does not apply, and Camardo S.p.A. will return the purchased item to the Customer, charging the Customer for the shipping costs.

With the above limitations, Camardo S.p.A. will refund the amount actually paid by the Customer within 14 days from receiving the withdrawal communication by the method agreed with the Customer.

Warranty

All products, except food items, sold by Camardo S.p.A. are covered by the manufacturer’s conventional warranty and a 24-month warranty for conformity defects pursuant to Legislative Decree No. 24/2002 and subsequent amendments and articles 130 and 132 of Legislative Decree No. 206/2005. To avail of warranty assistance, the customer must keep the invoice and the transport document.

If the purchased product has manufacturing defects and/or has been damaged during transportation, the Customer may request its replacement within the strict deadline of 2 days from receipt by emailing info@camardo.shop. The Customer is also required to return the defective or damaged product in its original intact packaging with all its parts.

In case of product replacement, the return shipping costs are covered by Camardo S.p.A. Camardo S.p.A. will then replace the product with an identical one or, in case of stock depletion and upon agreement with the Customer, with one of equivalent value.

Applicable Law and Competent Court

The sale of products and/or provision of services takes place within the territory of the Italian State and is subject to the laws in force in the Italian Republic. The competent court for the resolution of any dispute will be that provided by Italian legislation in force at the time of concluding the contract.

CONCLUSION OF THE CONTRACT

To join the Program, registration on the Website by the Customer with a “username” and “password” and tax code is necessary. Otherwise, it will not be possible to proceed with the conclusion of the contract, and consequently, with the joining of the Program.

The Customer is required to protect the username and password used to register on the Website and is responsible for any activity or action taken with their username and password. The Customer agrees to immediately notify Caffè Camardo of any unauthorized use of their username and password or any other security breach. Caffè Camardo cannot and does not intend to be liable for any losses or damages resulting from failure to comply with these.

To proceed with the conclusion of the contract, the Customer must complete the telematic procedure, the stages of which are clearly described through pages of the Website, and which describe the characteristics of the Program, products available for purchase through joining the Program, and accept these Terms and Conditions of Sale, which govern the supply of products under the Program.

To complete the membership of the program, the Customer must place an order by selecting the products they wish to include in their subscription, among those available for joining the Program and other elements of choice by the Customer to include in their subscription (e.g., periodicity of subsequent order deliveries). Subsequently, the Customer must enter the billing and shipping details for the products purchased with the Program.

By joining the Program, the Customer consents to Caffè Camardo issuing, according to the chosen periodicity, subsequent orders for the supply of products for the selected subscription duration.

Upon joining the Program, summary information will be provided about the products available for purchase through the Program, including price information (including VAT and any other applicable taxes, which will be detailed on the invoice accompanying the delivery of the goods).

The contract is concluded upon the Customer’s receipt of an email confirmation from Caffè Camardo at the Customer’s email address, confirming the enrollment in the Program and summarizing the conditions related to the chosen Program formula as well as all other contract-related information as provided for in art.53 of Legislative Decree No. 206/2005. The Customer is also required to print and keep a copy of these Terms and Conditions.

Caffè Camardo sells and markets its products through the Website. The purchasable products are delivered by Caffè Camardo only and exclusively within the Italian territory, Republic of San Marino, and Vatican City. The language available to conclude the contract is Italian.

These Sales Conditions apply to contracts concluded pursuant to the previous article 4, subject to the General Conditions of Sale present on the Site (“General Conditions”). In case of conflict between these Sales Conditions and the General Conditions, the General Conditions shall prevail.

APPLICABLE LAW AND COMPETENT COURT

The Sales Conditions are governed by Italian law and in particular by Legislative Decree of September 6, 2005, No. 206 (Consumer Code), with specific reference to the legislation on distance contracts, and by other applicable Italian regulations concerning sales outside commercial premises.

The competent court will be that provided by Italian law in force at the time of concluding the contract.
